Can a banned player open a new account?
A horrific stalker player in my area has finally had a permanent ban, (thanks to niantic for finally acting on the 1000’s of complaints they must have received) but now the local community is suggesting the player will be restarting with a new account. Is that a fair circumvent of the rules? Or will niantic erase any new accounts by a banned player?

It's allowed (and even stated in the ban mail I believe).
So unless they change their ways or don't create a new one, you are stuck with them.
We've seen local players get banned for spoofing come back and just start new accounts. It's allowed. That's why reporting really doesn't do anything good for the game. It may slow them down temporarily but they always come back. Nothing you can do but accept it.

In our area if there a account banned then in few minutes new account born 😂
They might already have a leveled backpack they will just start using. Or at least they can login to Intel and track you. Niantic can do nothing about it.

I think he was NOT a stalker, he was just a tough agent who wanted to keep the green field. So we loved him, but you probably didn't.
You couldn't defeat him in the game, but you returned him to his wife :‑)

If someone is banned for good reason, then that should be the end of them for good. Not for that person to return a short while later, then potentially get up to past misdemeanours yet again.
So in theory, someone could physically assult you on the field, get banned, then be free to return under a new name a week later.
It doesn't matter what the rules say, it is just plain stupid.

Physically assaulting someone in the field isn't enough to get banned. You have to do something in the app. And yes you can come right back and keep playing. It's just the nature of a free app on a cell phone.
It is simple.
If someone is known to be a banned player whom has returned under a new name, then they should be reported and promptly kicked out with yet another ban.
Keep doing it until the person gets the message - they are no longer wanted in the game.
They will soon tire of having to keep starting over.

It's enough to get someone locked up though. If you're more concerned with your gameplay than your physical safety, there's priority issues. If someone physically assaults you for ANY reason, call the cops.
It really isn't.
Niantic doesn't have the means to correlate 2 accounts. Are they just going to believe you? If they did every report would result in a ban.
And how do you suppose you can provide evidence without breaking the TOS and privacy regulations?
If they breach tos and do something against rules yes but a new player can open a new account and behave then they cant get banned.
and this is the problem how do u prove something that happens if its real life **** ? or something else verbal abuse or whatever....
