When it says CLEARLY that using multiple accounts for one service (ingress is one service, poGo is another service) it means that it is cheating. It makes no difference if you access such service through one device or more than one. Multiple account is cheating. Period. It cannot be that difficult to understand, seriously.

It is because of people like you that some games prohibit you from opening another account with the same device. Even if it is only to help a player was blocking due to lack of battery or network... not to mention the young people who only play on their parents' laptop on weekends.

I'm not sure how Ingress could make their TOS any clearer on this subject. If you were honestly unsure about the answer, I fear for you. but I guess there truly is no limit to human intelligence; positive, or negative.
I guess if anyone is honestly asking these questions, maybe Niantic should provide a more thoroughly spelled out TOS. I'd hate to think the reason I have so many different "Agents" in my area that all deploy at the same time to the same portals is because someone misunderstood the TOS.
The Rules are clear. All Niantic games run under a single Terms of Service document, and each game has its own Guidelines document. Collectively, these are known as the Terms, If you only read one document, then you are wilfully omitting part of the Terms because you don't like the content.
That is the mark of cheating. Ignoring rules because they don't let you play how you please.
If you want to cheat, we can’t stop you. No one can. If you want to validate your multiple accounts by using multiple devices, go for it. We can’t stop you from rationalizing the way you cheat, either. Possibly you’ve found a way to cheat that Niantic is unable to enforce against. At some point this all comes down to an honor system. Niantic is not going to spend all their resources chancing down every last cheater. Fortunately there are enough people that want to play an honest game. It just appears you’re not one of them.
So to the OP, it's safe to say that play whatever style you want to play. There is no need to justify it from a legal point which.
If you feel the TOS need an update, suggest some. If you feel you can circumnavigate it to your liking, by all means go ahead.
Just don't open another thread if (for example) your or your wife acc got banned. Do remember you already clicked "i agree/accept" on the TOS when you first played the game.
And skirting them should put a target on your back, whether it is extra agents taking your stuff down, or reports. Do you really want the target on your back?

So what's the point of ToS sections ignored by -80% of the players and unjudged by Nia?
If the answer is: too hard to detect, then Nia should remove the section und prevent cheating by eg.: no item drop at all anymore... Problem solved.

What would you think of a player who says that he took over his account from his brother, for example? Is this against ToS or some kind of a shady zone?
My main device, I use day to day, it has chat apps, email, weather etc. And Ingress. I use it 99.9% of the time.
The other device has nothing on it except Ingress, (OK it has some preinstalled junk from the manufacturer I can't get rid of).
I use it for low signal portals where every byte counts, the other device is powered down usually at this time. Last thing I want is app updates/animated GIFs at a portal where getting ANY data connection is tricky.
@SSSputnik I think we are all in agreement that there is nothing wrong with having one account on multiple devices. There was a tempest in a teapot on G+ some years ago about whether you could actively use two devices at once but there was never any question that having your account on multiple devices at once was fine. I have a similar situation with multiple phones/carriers and all but one device is very stripped down.
The negative "multiple devices" comment earlier was about having multiple accounts, each on a different device.
@EvilSuperHeros Technically it's not legal to multi-account in other games as well. The last time I checked both HPWU and PoGo had the same rules about only using one account.
PoGo multi-accounters can really **** with the gym game when one person takes over a gym and then completely fills it with their multiple accounts. They get to trade with themselves and stock up on gear and get bonuses. PoGo multi-accounting causes some serious problems in Wayfarer... if you have a few people in an area that have 5+ accounts each and they're all reviewing the same stuff then they essentially get to set their own rules for the area.

Seems quite simple to me. If you're not holding the scanner with your OWN account, you are by definition spoofing since you are not there. Or someone is for you. Is this confusing?
I'm not sure what other games you're familiar with, but if it's pogo, ingress's closest relative, basically everything is opposite. Dual-wield phones, your own same-team, other, stuff gyms with your own or your friends accounts, 'solo' raids with just you and 10 phones from your friends and family and their baby accounts - noone cares, niantic won't do anything about it, not by themselves, not if 20 people present strong evidence. In ingress, the TOS are identical. However, if your very own team think you're either account sharing or multiaccounting, they will report you, even just putting up a few level 7 portals near home. If as a newer player, people suspect this, you may not get invited into the higher-level local faction chats.
It's quite possible for several people to each spend several months planning a 1 hour operation. No one wants the achievements of such effort to be cheapened by accusations of cheating. Everything would be easier if it didn't require 4-24 agents to be in the same (often remote) places at the same time,.

If the brother no longer uses the account but the player is using it instead, then yes, that is shady.
